State Bar Defense

You are hesitant to quote ranges to your clients and, for well known reasons, so are we. Like civil litigation, a case can take on a life of its own and fees can skyrocket; however, below is a general framework:

Typically, a one count investigation costs between $2,000 and $6,000. Each additional complainant usually means a repeat of the attorney fees and costs.

If we have to take a case to pre-filing conferences, typically you incur an additional $3,000 to $10,000.

If the State Bar files formal charges, and if you settle prior to the filing of a pretrial statement, additional fees typically run in the $10,000 to $25,000 range. Extensive discovery or heavy document cases will run higher. The Pretrial Statement and Pretrial Conference can add $6,000 to $15,000 range. These are like federal cases, fully briefed and exhibits swapped. The more complex your case, the more exhibits, the longer the Pretrial Statement, the higher your fees are.

A rule of thumb for trial is $4,000 per trial day, $3,000 for prep days, $5,000 for the post trial brief.

Appeals

If you go up on appeal to the Review Department or the Supreme Court, and if we were the trial attorneys, add about $20,000 and up for each level of appeal, depending on the length of the transcript and the number of exhibits. If you first hire us for an appeal, the fees can easily be twice that amount. Again, these are estimates, not guarantees.

Reciprocal Discipline

If you consent to reciprocal discipline by Federal courts and agencies, there is minimal extra cost. If they insist on a separate hearing, or if you do, we can create a custom budget for you.

Suspension and Restoration to Practice

There are also extra fees to: plan for suspension, carry out probation conditions, deal with post discipline fallout.

Moral Character

When we help you explain events on your application, a typical fee is $1,500 - $3,000. Some people have complex problems that can take $3,000 to $6,000 or more to research, draft and explain.

If you are called in for a personal interview, prep time is typically $1,500 - $3,000 and another $1,500 - $2,500 for the interview itself.

Ethics Advice

Ethics advice is charged on an hourly basis. Our ongoing clients often get questions answered in 10-20 minutes. We will estimate the range for new or returning clients on request.
